Privacy Policy
1. Data controller
This policy applies to the Elemn shop (elemnsounds.com) and to all digital sound packs sold under the Elemn brand. Data controller: Lucien Guirado, sole trader (micro-entreprise), trading as Elemn. Registered in France (Paris). Postal address available on request. SIRET: 979 313 459 00013. Contact: contact@elemnsounds.com There is no dedicated Data Protection Officer. Privacy requests are handled directly by the controller.
2. What this site does
The site is a storefront and product showcase. It does not process card payments or store checkout data on our servers. Purchases, invoices, applicable taxes and download delivery are handled by Creem (creem.io) as Merchant of Record (see section 4). We may receive limited purchase-related information from Creem (for example customer email and order details) only to provide support or restore download access.
3. Data we collect on this site
Contact form (optional): name, email address and message content. Newsletter signup (optional): email address and, where applicable, language preference (see section 6). Technical data when you browse or submit a form: IP address, browser type, timestamps and similar server logs, processed by our host (PulseHeberg) for security and operation. Anti-spam measures: honeypot field, minimum delay before submit and field length limits. We do not operate user accounts, audience analytics or advertising profiles on this site.
4. Purchases via Creem
When you buy a pack, you are redirected to Creem checkout. Creem collects and processes the data needed for payment, invoicing, tax and digital delivery (for example name, email, billing country, payment method and transaction records). We do not receive or store your full payment credentials. We can still help with product support via contact@elemnsounds.com.
5. Contact form processing
If you use the Contact page, your message is processed server-side on our host (PulseHeberg) via a PHP script and sent by email to contact@elemnsounds.com. Messages are then stored in our Gmail mailbox (Google). Purpose: answer your questions about packs, licensing, downloads or support. Legal basis (GDPR): legitimate interest in responding to requests, or steps prior to a contract when your message relates to a purchase.
6. Newsletter (Brevo)
If you subscribe to our newsletter using the form on the site, we collect your email address and, where applicable, your language preference (EN/FR). This data is sent to Brevo (Sendinblue SAS, France), which handles our email campaigns and subscriber list hosting as a processor. Purpose: inform you about new packs, demos and Elemn updates. Legal basis (GDPR): your consent, given when you submit the signup form. You may unsubscribe at any time using the link in each email or by contacting us at contact@elemnsounds.com. 7. Audience analytics
We do not currently use audience analytics tools (such as Umami, Google Analytics or similar services). No visit statistics are collected on this site at present. If that changes, this policy will be updated before any analytics tool is enabled.
8. Cookies and similar technologies
We do not use advertising, social-media or audience-measurement cookies. The site may rely on strictly technical processing by our host (connection logs, HTTPS). We do not deploy a marketing cookie banner because we do not run ad or cross-site tracking.
9. Recipients and sub-processors
Your data may be processed by the following providers acting on our instructions or as independent controllers: • PulseHeberg — website hosting and processing of contact and newsletter forms (France): https://pulseheberg.com/fr/ • OVH — domain name registration for elemnsounds.com (France) • Google (Gmail) — mailbox for contact@elemnsounds.com (may process data outside the EU) • Brevo (Sendinblue SAS) — newsletter delivery and subscriber list management (France): https://www.brevo.com/legal/privacypolicy/ • Creem (Armitage Labs OÜ) — checkout, payment and digital delivery (Merchant of Record): https://www.creem.io/privacy We do not sell your personal data.
10. Retention
Contact messages: kept in our Gmail mailbox for as long as needed to handle your request and any follow-up, then deleted or archived according to our usual email practice. Newsletter: your email address remains on our Brevo list while you are subscribed, then is deleted or deactivated after you unsubscribe, according to Brevo settings and our procedures. Server and security logs: kept for a limited period by PulseHeberg for security and troubleshooting. Purchase and invoice data: retained by Creem under its own policies and legal obligations.
11. International transfers
Some providers listed above may process data outside the European Economic Area (for example in the United States). Where required, transfers rely on appropriate safeguards such as standard contractual clauses or equivalent mechanisms offered by those providers.
12. Your rights
Under the GDPR, if you are in the EU/EEA you may request access, rectification, erasure, restriction, objection (where applicable) and data portability for data we control. To exercise your rights, including unsubscribing from the newsletter, contact us via the Contact page or at contact@elemnsounds.com. We will respond within one month, unless the request is complex. 13. Security and minors
We use HTTPS, server-side validation on the contact and newsletter forms, and anti-abuse measures to reduce spam. The site is not directed at children. Product pages may describe explicit content where relevant; there is no site-wide age gate. You are responsible for choosing products appropriate for your use.
14. Changes
